New York proposes first statewide standards for high school dual enrollment programs

The New York State Education Department has introduced a proposal for statewide regulations aimed at standardizing dual enrollment programs across the state. Dual enrollment allows high school students to earn college credit while completing their high school graduation requirements. According to research, participation in these programs is linked to improved student outcomes, including higher graduation rates and increased college enrollment and degree completion.

Despite having the third-largest dual enrollment population nationally, New York previously lacked a uniform policy governing these programs. The proposed regulations are intended to establish consistent quality and accountability measures statewide, with an emphasis on expanding access for historically underserved students.

Chancellor Lester W. Young, Jr. stated, “This proposal builds upon the Board’s unwavering commitment to equity and excellence. With these regulations, we are rewriting the playbook to make sure dual enrollment is rigorous and informed by data. This is about building stronger partnerships and creating pathways to opportunity that will shape lives for generations to come.”

Commissioner Betty A. Rosa commented, “These proposed regulations are equity in action. By setting clear statewide standards for dual enrollment programs and strengthening partnerships between P-12 schools and colleges, we are leveling the playing field. In these programs, students have the chance to earn college credit, build confidence, and step into their future prepared to succeed in college, careers, and beyond.”

Key aspects of the proposed regulations include requirements for partnership agreements between P-12 educational entities (such as school districts, charter schools, and BOCES) and colleges or universities by September 1, 2026. These agreements must be updated at least every five years.

The regulations also call for annual reporting of participation and outcome data from both P-12 partners and higher education institutions. This information will be published on the Department’s website each year as a transparency measure.

Additionally, all dual enrollment courses must be credit-bearing offerings listed in the partner institution’s course catalog with learning outcomes and content equivalent to other sections of the same course.

A Notice of Proposed Rule Making is scheduled for publication in the State Register on September 24, 2025. This will initiate a 60-day period during which public comments can be submitted regarding the new rules.
